Damages awarded in Busby case

More than a year after a federal district court found that the administrative fees charged by a brokerage violated RESPA, an estimated 30,000 homebuyers and sellers may begin filing claims against RealtySouth. It is estimated the damages against the brokerage could total more than $13 million.

The court in this class action lawsuit, Busby vs. Realty South, found that the brokerage was charging a fee for which no services were performed. Because this case involved a RESPA violation, the court tripled the damages awarded members of the class. Buyers and sellers who paid the $149 administrative fee to RealtySouth between September 2003 and March 2009 are therefore entitled to refunds of $447 each. To be eligible, claims must be made by Dec. 15, 2010.

RealtySouth is appealing the decision.
